Welcome to Formasio. We take your privacy seriously, because we value your trust. This privacy policy ("Policy") applies to your use of Formasio’s website, products and apps (together, the "Services"). This Policy is intended to inform you (“User,” “Users,” “You,” “Your”) about the information we collect from you, how we use that information, and what your options are to manage your privacy, so you can make informed decisions about using our Services. By using our Services you agree to and accept to be governed by this Policy, as well as the Terms of Use that are incorporated herein. If you do not agree to any part of this Policy or the Terms of Use, then you may not not use Formasio.

1. Usage, log and traffic information

When you use our Services, we automatically collect various information that enables us to provide our Services, such as your computer's Internet Protocol (IP) address, operating system and browser type, the address of a referring website or a website to which you navigate from Formasio, the date and time you access or use our Services, your mouse movements, links you click on, pages you view and the amount of time you spend on a particular page (“Traffic Information”). This Traffic Information allows us to provide and maintain our Services, process authorized payments, diagnose problems with our servers, analyze traffic, and optimize Formasio. Formasio does not sell, rent or lease its customer lists to third parties beyond the aforementioned uses.

Formasio may disclose personal information when required by law, such as to comply with a court-issued subpoena, warrant, or with a binding, lawful court order, to meet the requirements of law enforcement where appropriate, to investigate suspected fraud, where necessitated by an emergent situation or the imminent loss of life or limb, to enforce Formasio’s Privacy Policy, to protect the rights, property and safety of Formasio and its users, or to protect Formasio and its users from the unlawful use of its Services.

2. Cookies

Formasio automatically collects certain information through “cookies" and similar tracking technologies. Cookies are small pieces of data that are sent from Formasio and stored on a user's computer or device through the use of a browser, which allow Formasio to recognize previous visitors and automatically populate information such as login credentials, information from previously populated forms, preferences, and browsing history. Users can delete or block cookies by reviewing the browser’s settings through the “help” button. However, users who elect not to accept cookies will not be able to sign in, submit information, download forms, make payments, or otherwise functionally use Formasio as intended.

3. Personal information

Formasio collects and stores personal information (“Personal Information”) from its Users in order to provide the Services that Users expect. "Personal Information” includes any information that can identify a given user, and it includes a user’s name, address, telephone number, email address, credit card or bank account number, passport number, alien number, social security number, gender, height, weight, eye color, hair color, race, ethnicity, address history, criminal history, immigration status, aliases, country of birth, country of nationality, marital status, names of parents, spouses, ex-spouses, children, name and address of current and past employers, current and past occupations, international travel history, memberships in groups or organizations, party affiliations, military service, and selective service registration status. This information is frequently required by U.S. Citizenship and Immigration Services (“U.S.C.I.S.”) on its petitions, applications or other forms. Additionally, Formasio collects financial information in order to facilitate payment for its Services.

We use Personal Information to facilitate the use of our Services, to process requests or transactions (such as passport information to obtain travel information from the Customs and Border Protection website, subject to its own terms of use), to provide you with immigration forms and services requested (such as to keep you updated on the progress of your application with U.S.C.I.S), to operate our business, and for the purpose for which the information was provided. We do not disclose, rent, sell or otherwise make available your Personal Information to third parties for direct marketing purposes.

4. Non-personal information

We use information other than Personal Information, including aggregated or anonymized information, to analyze web traffic data, administer the Services, improve customer service, diagnose problems with our servers, track User movements, and gather demographic information for aggregate use.

5. Third party service providers

In the event that we engage with third party service providers in connection with our Services, we may share Personal Information with such service providers who need access to such information to carry out their work for us. For example, we may use credit card processing or verification companies to verify credit card information or to verify your identity. Other than such service providers, we do not share Personal Information with third parties unless (1) you have indicated to us that you wish to receive information from such parties; (2) you otherwise give us your consent to do so; or (3) in response to a request for information or a subpoena from law enforcement, as described in paragraph 9, below.

7. Managing communications preferences

In order to provide you with Services, Formasio reserves the right to communicate information to you by email, such as receipt numbers for forms filed, case update information, information about form updates, payment receipts, password resets, and account information. However, Formasio also gives you the option to receive general information such as newsletters and offers. You have the option to opt out of such general information by following the unsubscribe instructions included in those emails.

8. Requests for information for law enforcement and safety purposes

Formasio may disclose personal information when required by law, such as to comply with a court-issued subpoena, warrant, or with a binding, lawful court order, to meet the requirements of law enforcement where appropriate, to investigate suspected fraud, where necessitated by an emergent situation or the imminent loss of life or limb, to enforce Formasio’s Privacy Policy, to protect the rights, property and safety of Formasio, its users and its employees, or to protect Formasio and its users from the unlawful use of its Services.

9. Attorney Offramp

Formasio reserves the right to refuse to provide Services to users for whom it is reasonably foreseeable that, based on a User’s input, the User will require the services of an attorney. In such cases, Formasio will offer Users the option to forward the information provided to a prescreened immigration attorney (“Attorney”). We review the Attorneys we contact to ensure that they are licensed to practice law in their jurisdiction and are in good standing, but we do not endorse or recommend any attorney. Formasio makes no representation, warranty, or guarantee about the competency, experience, or qualifications of any attorney, nor as to the accuracy or sufficiency of such attorney’s work. Formasio will not forward User information to Attorneys without Users’ consent. Information provided to Formasio is not protected by the attorney-client privilege doctrine.

Additionally, Formasio takes reasonable measures to ensure that its users do not mistakenly file a petition or application with USCIS that negatively affects their rights or interests, and directs such User to contact an attorney. For example, if a user indicates that they are under eighteen, that they have been arrested, or that they are or have been in removal, exclusion, or deportation proceedings before the Executive Office of Immigration Review (“EOIR”), among other disqualifying grounds (“Prohibited Users”), Formasio excludes such Prohibited Users from using Formasio’s Services, and records identifying information about Prohibited Users, such as IP address, alien number and/or passport number in order to identify and exclude Prohibited Users from Formasio’s services in the future. This mechanism is called the “Attorney Offramps,” and it has been designed in consultation with a licensed attorney in good standing with the bar of New York who actively practices immigration law and is qualified to consult on its design.

The Attorney Offramp is merely an automated screening mechanism, and although it is designed by an attorney in good standing with the New York bar and who actively practices immigration law, and it is a mechanism that is reasonably calculated to give fair notice to Users who may be harmed by the filing of a particular form and prevent them from using Formasio’s Services, it is not a substitute for the legal judgment and advice of an attorney. Additionally, it is not a mechanism that provides legal advice, or applies the law to the facts of a User’s circumstances, but merely an automated screening mechanism designed to protect the User and Formasio by prohibiting such user from using Formasio, and giving that User fair notice that based on their input, such user is well-advised to seek the counsel of an experienced immigration attorney, and provides access to such attorneys.

Once a User has decided to enlist the help of an immigration attorney, Formasio no longer participates in that User’s petition or application, except to forward that User’s information to the attorney of that User’s choice with the User’s consent.

10. Securing your Information

Formasio secures your Personal Information from unauthorized access, including passwords, alien numbers, passport numbers and financial information, by implementing procedures reasonably calculated to safeguard information collected from you. We use encryption such as Secure Socket Layer (SSL) to store and transmit financial information such as credit card information, to prevent unauthorized access, use or disclosure. Your account is accessible only through the use of a password, which you are responsible for safekeeping. However, no security system is impermeable, or immune from attack. Please alert Formasio immediately of any unauthorized use of your account by emailing Please do not send sensitive information to this email, such as passwords, personal identifying information, or account information. Formasio will never ask you for your password.

11. Children under Thirteen

Formasio and its Services are not intended for use by children under the age of thirteen (13), and such individuals are prohibited from using Formasio. We do not knowingly collect personally identifiable information from children under thirteen (13), except inasmuch as they are dependents or derivative beneficiaries on an adult User’s petition or application for benefits with U.S.C.I.S..
